Terms of service

Last updated 3 November 2026

These terms govern your use of EngineKit (the “Service”), operated by Ercaap Mobile App ve Yazılım Teknolojileri Limited Şirketi (“we”, “us”). By joining the early-access list, creating an account or using the Service, you agree to them. If you use the Service for an organisation, you confirm that you may accept these terms on its behalf.

1. Preview

The Service is in preview. Accounts open in waves from the early-access list, and features, limits and prices may change before and after launch. We will tell you before a price change applies to you. During the preview there is no service-level commitment.

2. Your account

  • You must be at least 18 years old, or the age of majority where you live.
  • Keep your details accurate and your sign-in, API tokens and CLI sessions secure. You are responsible for what happens under your account.
  • One account per person. Tell us at once if you suspect someone else is using yours.

3. The Service

EngineKit rents cloud CPU and GPU workstations (“rigs”) that run on infrastructure from our compute providers, with storage for your projects and backups, a command-line tool and an API.

  • A rig is billed per second while it is allocated. Its hourly rate is shown before it starts and stays fixed for that session.
  • Hours are your balance divided by a rig's hourly rate, so the same balance lasts longer on a smaller rig.
  • Preemptible (spot) rigs can stop without notice. Rigs are temporary machines: keep copies of anything important in your project storage or elsewhere.

4. Your content and the software you run

You keep all rights in your projects, files and outputs. You give us a limited licence to host, copy, transmit and process them only to run the Service for you.

You install and license the software you use on a rig — engines, tools, AI models and assets — and you must follow their licences and terms. We do not provide licences for third-party software.

5. Acceptable use

You must follow our Acceptable use policy. We may stop rigs and suspend accounts that break it.

6. Plans, hours and payment

Our order process is conducted by our online reseller Polar Software Inc., the merchant of record for all our orders. Polar takes payment, adds and remits taxes where they apply and issues your invoice; its buyer terms apply to your purchase.

  • Monthly plans renew every month until you cancel. A plan's monthly hours reset at the end of each billing period and do not carry over.
  • Extra hours are a one-time purchase and stay valid for 12 months from purchase.
  • Prices are shown without taxes. Hours and plan allowances are added to your account only after a paid order.
  • A failed or disputed payment can pause your rigs and your account until it is resolved.

Refunds follow our Refund policy.

7. Suspension and closing an account

We may suspend or close an account to stop abuse, fraud, a security risk or a serious breach of these terms, and we will tell you why unless the law or an investigation prevents it. You can close your account at any time. When an account closes, its rigs stop and its data is deleted as described in our Privacy notice.

8. Third-party services

Parts of the Service rely on other providers — our compute and hosting providers, Polar for payments and, if you choose to use it, GitHub for sign-in. Their own terms apply to their services.

9. Disclaimer

To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of uninterrupted availability or of fitness for a particular purpose.

10. Liability

To the extent the law allows, our total liability for any claim about the Service is limited to the amount you paid for it in the 12 months before the claim, and we are not liable for indirect or consequential loss, or for lost profits or data. Nothing in these terms limits liability that cannot be limited by law, such as for intent, gross negligence or personal injury, and nothing affects the statutory rights you have as a consumer.

11. Governing law

These terms are governed by the laws of the Republic of Türkiye, and the courts of Istanbul have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring a claim there.

12. Changes to these terms

We may update these terms. For changes that affect you materially we will give notice by email or in the Service before they take effect; continuing to use the Service afterwards means you accept them.
